These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Moment ("Company," "we," "us," or "our") governing your access to and use of our website at https://ourdailymoment.com and our mobile and web application (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.
1. ELIGIBILITY
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you meet this requirement. If you are under 18, you are not permitted to access or use the Services.
2. ACCOUNTS
To access the Services, you must register for an account using Google OAuth. You agree to:
- Provide accurate and complete registration information.
- Maintain the security of your account and promptly notify us of any unauthorized use.
- Be responsible for all activity that occurs under your account.
- Maintain only one account per person.
We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms.
3. PARTNERSHIPS AND INVITATIONS
The Services allow you to form a linked partnership with one other user. By sending or accepting a partnership invitation, you acknowledge and agree that:
- Each account may be linked to only one partner at a time.
- You will not invite yourself or create fake accounts to form a partnership.
- You consent to sharing your prompt responses with your linked partner once both of you have chosen to reveal.
- We are not responsible for the conduct or content submitted by your partner.
4. USER CONTENT
You retain ownership of any content you submit through the Services, including your prompt responses ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to store, process, and display that content solely for the purpose of operating the Services.
You agree not to submit User Content that:
- Is unlawful, threatening, harassing, abusive, defamatory, or obscene.
- Violates the rights of any third party, including intellectual property rights or privacy rights.
- Contains malware, viruses, or any other harmful code.
5. PROHIBITED CONDUCT
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any part of the Services or another user's account.
- Scrape, crawl, or otherwise extract data from the Services without our express written permission.
- Interfere with or disrupt the integrity or performance of the Services.
- Impersonate another person or misrepresent your affiliation with any person or entity.
6. INTELLECTUAL PROPERTY
The Services and their original content (excluding User Content), features, and functionality are and will remain the exclusive property of Moment and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You may not copy, modify, distribute, sell, or lease any part of the Services without express permission.
7. DISCLAIMERS
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOMENT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.
9. THIRD-PARTY SERVICES
The Services rely on third-party services including Google (for authentication) and Supabase (for data storage and authentication infrastructure). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.
10. TERMINATION
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease. You may also delete your account at any time by contacting us. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.
11. CHANGES TO THESE TERMS
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Services after any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Services.
12. GOVERNING LAW
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, as permitted by law.
